Dylematy funkcjonowania samorządu w Polsce ze szczególnym uwzględnieniem samorządów wojewódzkich

Dilemmas of self-government functioning in Poland with particular emphasis on self-government authorities

Streszczenie:
Utworzenie trzy stopniowej struktury samorządu terytorialnego w Polsce i jej dwudziestopięcioletnie funkcjonowanie (samorządy powiatów i województw osiemnaście lat) pokazało, że jest to jedna z najlepszych reform w Polsce po 1989 r. Wymagały te działania woli politycznej kolejnych rządów RP polegającej na rezygnacji Centrum z części swojej władzy. Nadanie samorządom osobowości prawnej, źródeł finansowania oraz prawa dochodzenia swojej racji przed sądem pozwoliło jednostkom samorządu terytorialnego sprawnie funkcjonować. Dotychczasowe doświadczenia wskazują także na potrzeby korekt legislacyjnych, usprawniających działanie j.s.t. Zachodzi potrzeba większej partycypacji mieszkańców wspólnot samorządowych w procesie decyzyjnym, zobowiązania rządu do całkowitego finansowania zadań zlecanych samorządom oraz wzmocnienia pozycji organów stanowiących j.s.t. wobec organów wykonawczych.

Abstract:
The creation of three-stage structure of local government in Poland and its twenty-five years of functioning (self governments of districts and voivodeships for eighteen years) proved to be one of the best reforms in Poland after 1989. These actions required political will of following governments of Poland depending on the resignation of Centre from part of its power. Giving local governments the legal personality, financing sources and the right to claim their rights before the court made the local government units to function efficiently. Past experience also show the need for adjustments of legislative action to improve local government units There is a need for greater participation of the residents of local communities in decision-making process, the Government's commitment to complete financing of tasks commissioned to local governments and empower the position of decision-making bodies of local government units to executive bodies.
